Just got a love note from these guys - as a FFL, I am required (by an illegal rule promulgated by an illegal bureaucracy) to use the latest and greatest issue of the good-old 4473 form whenever I transfer a freedom tool to a citizen exercising his or her inalienable right - as guaranteed to not be infringed by the Second Amendment of that almost forgotten document.
Well, the pencil-pushers decided that there's no reason anymore to verify that a resident alien is truly a resident of the state he or she attempts to purchase a firearm in - so all those yellow 4473s are not obsolete and "illegal" to use after July 9th.
So, a stack of about 200 of them just went into the garbage - I won't glorify them with recycling.
How many millions were just wasted on printing a new 4473, and mailing half a ream of paper to every FFL in America?
So- I as a born citizen of the United States, who lives in TX (and has my own unmodified birth certificate and the SSN that was issued to myself originally)cannot legally by a fire arm from you---
ReplyDeleteBut my wife who has a green card and is a citizen of the U.K can buy anything she wants?
...Or do you even get a chance to ask to see it, since it might hurt some ATF agents feelings if you asked an illegal for one and he couldn't produce it?
Old 4473, question 11(l):
ReplyDeleteAre you a nonimmigrant alien? (See instructions for Question 11.l) If you answered "no" to this question, do NOT respond to question 12 and proceed to question 13.
Question 12:
If you are a nonimmigrant alien, do you fall within any of the exceptions set forth in the instructions? (If "yes", the licensee must complete question 20d.)(See instructions for Question 12.) If question 11.l is answered with a "no" response, then do NOT respond to question 12 and proceed to question 13.
New 4473, question 12:
If you are an alien admitted to the United States under a nonimmigrant visa, do you fall within any of the exceptions set forth in the instructions? (If "yes", the licensee must complete question 20c.)(See instructions for Question 12.) If question 11.l is answered with a "no" response, then do NOT respond to question 12 and proceed to question 13.
The old 20.c requested proof of 90-day residency for all aliens. This requirement has been removed now. US citizens only must prove residency, there's never been a requirement to prove how long you've lived there.
They do require me to look at the supporting documents. At least there's no restriction on "profiling" here.
Still a horrible waste of taxpayer-purchased paper.
You couldn't legally buy direct from me anyway - only residents of "neighboring states" can buy LONG guns out of state. Handguns are only legal to purchase where you live - if permitted.
ReplyDeleteInteresting twist here - you can buy an evil AR pattern black rifle in Oklahoma, for instance, and then purchase a pistol upper for it anywhere - the upper receiver is not legally a "gun" - and (illegally) put the pistol upper on the "rifle" lower - and have a "handgun". Of course, if the feds catch you, you're in a world of hurt fro possessing and unregistered short barreled rifle...
